Respecting the right to privacy of individuals who visit the deffor.pl website, we wish to declare that we process the data thus obtained in accordance with national and European laws and in conditions that ensure its security, i.e., its confidentiality, availability, integrity, and accountability. To ensure the transparency of our data processing processes, we present the Company’s personal data protection principles, established under Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, hereinafter “GDPR”).

In connection with your use of our website, we process the following personal data obtained through:

The Controller processes your personal data for the following purposes:

  1. enabling you to use our website for information purposes (legal basis: the Controller’s legitimate interest in ensuring access to its website, the functionality and optimization of websites, and the security of IT systems, i.e., Art. 6, paragraph 1, letter f) of the GDPR),
  2. exchanging correspondence by responding to inquiries sent via the “Contact” contact form (legal basis: the Controller’s legitimate interest in ensuring access to its website, the functionality and optimization of websites, and the security of IT systems, as well as enabling you to contact the Company or submit inquiries/objections, Art. 6, paragraph 1, letter f) of the GDPR),
  3. sending commercial information for marketing purposes, including providing information about the Company’s products or services (legal basis: the Controller’s legitimate interest in ensuring access to its website, the functionality and optimization of websites, and the security of IT systems, i.e., Art. 6, paragraph 1, letter f) of the GDPR, subject to your separate consent to select a specific communication channel by checking the appropriate checkbox, in accordance with separate provisions in this regard),
  4. reporting or refuting legal claims related to the operation of the website and the prevention and investigation of crimes (legal basis: legitimate interest of the Controller, i.e. Article 6 paragraph 1 letter f) of the GDPR).

IV. To what recipients may we share your personal data?

Recipients of your personal data may include authorized public authorities and entities providing services on behalf of the Controller, based on concluded contracts and in accordance with the Company’s instructions.

V. How long will we process your personal data?

Your personal data will be processed until the legal basis for processing expires, the purpose of processing is achieved, or it expires for another reason. If:

  1. The basis for processing is the Company’s legitimate interest, personal data will be stored until the legitimate interest of the controller is fulfilled or you object to the processing of your personal data.
  2. If we process personal data based on your consent, they will be processed until you withdraw your consent, which will not affect the lawfulness of the processing carried out by the Company based on consent before its withdrawal.

The above-mentioned data processing periods may be extended if their processing is necessary to establish and pursue potential claims or defend against claims, and after that time only if and to the extent required by law.

VI. Do we make automated decisions regarding your data?

No automated decisions (decisions without human involvement) will be made regarding your personal data, and your data will not be subject to automated profiling.

VII. What rights do you have in connection with our processing of your personal data?

The Company allows you to exercise the following rights:

  1. Access to data content – ​​you are entitled to access your personal data and obtain a copy of it. Furthermore, you have the right to obtain information regarding, in particular, the purpose of processing, the categories of data being processed, information about recipients, the planned retention period of your data, and your rights;
  2. Data deletion – if your personal data is no longer necessary to achieve the purpose for which it was collected, or you object to the processing of your data, and at the same time, we have no overriding legitimate interests, or if you believe that we are processing your data unlawfully, you have the right to request its deletion, in whole or in part. However, this right does not apply to data to the extent that it is necessary to pursue, establish, or defend our claims, or to comply with our legal obligations to process or store it under applicable law;
  3. Restriction of data processing – if you believe we have incorrect data about you, or if we are processing it without justification, or if you do not want us to delete it because you need it to establish, pursue, or defend legal claims, as well as in the period before you object to data processing – you have the right to request that we limit data processing solely to storing it or performing other activities agreed with you. Despite exercising the right indicated above, we may process your data in the event of establishing, pursuing, or defending legal claims;
  4. Objection to personal data processing – for reasons related to your particular situation, you may object at any time to our processing of your personal data if we process it based on our legitimate interest. After filing an objection, we will no longer be able to process your personal data based on the above-mentioned grounds for processing, unless we demonstrate compelling legitimate grounds for data processing that override your interests, rights, and freedoms, or grounds for establishing, pursuing, or defending legal claims;
  5. File a complaint with a supervisory authority – If you believe that we are processing your personal data unlawfully, you have the right to file a complaint with the national supervisory authority, which is the President of the Personal Data Protection Office, based in Warsaw.

If you exercise the rights indicated above, please send your request by email to biuro@deffeor.pl or by post to the address indicated in point I. Please note that the rights indicated above are not absolute and will not apply in every case of our processing of your personal data.

We also inform you that before exercising the above rights, we are required to verify the person submitting the request as the entity to whom the personal data covered by the request relates.

VIII. Is the provision of personal data voluntary?

Providing data in the contact form is voluntary, although necessary for submitting an inquiry and for the Company to respond to the inquiry, or for submitting an application via the form provided on the website.
